To the extent we decide to sell or share data within the meaning of this statute, Nevada residents who wished to exercise this sale opt-out rights would be able to submit a request to the email address set forth at the bottom of this Privacy Policy. However, please know we do not currently actively collect or store Personal Information or otherwise sell data triggering that statute’s opt-out requirements or rights.
Rights in California
California Shine the Light Law
California’s “Shine the Light” law (California Civil Code Section § 1798.83) permits California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. We currently do not make any such disclosures to any third parties for direct marketing purposes, but, to the extent we were to undertake such disclosures to third parties, you would be able to make a request regarding such disclosures by sending us an email request to the email address set forth at the bottom of this Privacy Policy. .
California Do Not Track Disclosure (CalOPPA)
Pursuant to the California Online Privacy Protection Act (CalOPPA), at Cal. Business & Professions Code §§22575-79, to the extent we collect any Personal Information from any California residents, we are required to disclose to those California residents whether we respond to their “do not track” requests. More specifically, certain web browsers may allow a user to enable a “do not track” option that sends signals to the websites the user visits indicating that the user does not want the user’s online activities tracked. This is different than blocking cookies, and browsers with the “do not track” option selected may still accept cookies. Since there is currently no universally-accepted technology standard for recognizing and implementing “do not track” signals and since our Website and other services do not have the functionality to recognize or honor “do not track” browser signaling, we do not respond to “do not track” signals. While we do not meet the prerequisites for compliance with the CCPA (and are thus not presently required to comply), and while we also do not collect or store your Personal Information (and do not plan to), to the extent we at some point decide to collect or store your Personal Information, we will do our best to respond to your requests. Just as the CCPA provides, if we collect or store your Personal Information and if you are a California resident, you would be able to request once a year, free of charge, certain information regarding our disclosures of Personal Information to third parties for direct marketing purposes. Again, though, we do not currently collect or store such information, nor do we disclose or share any data or information to third parties, whether for direct marketing purposes or for any other purposes. However, if we were to engage in any direct marketing, and if you were to request it, we would provide a list of the categories of Personal Information disclosed to third parties for third-party direct marketing purposes, along with the names and addresses of these third parties. Can a Visitor delete or deactivate Personally Identifiable Information collected by the Site?
While we do not currently collect or store your Personally Identifiable Information, to the extent we at any time decide to collect or store it, we would provide Visitors with a mechanism to delete/deactivate Personally Identifiable Information from the Site’s database by contacting contact us at the email address at the bottom of this Privacy Policy. . However, because of backups and records of deletions, it may be impossible to delete a Visitor’s entry without retaining some residual information. If, for any reason, JAMS is unable to provide the arbitration services, then you or we may file a Dispute with any national arbitration company that handles consumer arbitrations following procedures that are substantially similar to the JAMS Rules. The hearing shall be conducted in the City of Pasadena, California. The decision of the arbitrator shall be final and binding upon all parties and any award of the arbitrator(s) may be entered as a judgment in any court of competent jurisdiction.
The prevailing party shall be awarded all of the filing fees and related administrative costs. Administrative and other costs of enforcing an arbitration award, including the costs of subpoenas, depositions, transcripts and the like, witness fees, payment of reasonable attorneys’ fees, and similar costs related to collecting an arbitrator’s award, will be added to, and become a part of, the amount due pursuant to this provision. Any questions involving contract interpretation shall use the laws of California.
To the fullest extent allowed by applicable law, you and we agree that each party may bring disputes against the other party only in an individual capacity. YOU THUS WAIVER YOUR RIGHT TO BRING ANY DISPUTE AS A CLASS ACTION OR COLLECTIVE ACTION OR CLASS ARBITRATION.
